EDUCATION AS A SOCIAL RIGHT: A BRIEF REVIEW OF NORMATIVE DOCUMENTS WITH A VIEW TO SPECIAL EDUCATION

Abstract

With the recognition of education as a social right through the promulgation of the Federal Constitution of 1988, legal provisions were created to guarantee the fulfillment of this right. This article intends to analyze some of the documents published from this historical event, seeking to identify the elements that regulate the offer of special education in Brazil. It is concluded that, in general. the legal provisions that refer to the social inclusion of people with disabilities were improved in order to establish more specific definitions and guidelines on the subject. With regard to special education, there was an evolutionary movement in search of overcoming the substitutive character of specialized educational assistance to the detriment of common education.
